Welcome to The BOSs™, The Business Operating Systems, where you can have immediate access to an array of business aides and services using the most advanced web based tool available. By using The BOSs™, you agree to the following Terms of Service, which you should read carefully.

When you register, you must have a valid e-mail account and all other registration information must be valid. If the information is determined by our staff at any time to be incomplete, misrepresentative, or invalid, the access to the The BOSs™ will immediately be terminiated.

Your Use of The BOSs™

You are free to use The BOSs™ for any lawful, worthy and ethical purpose, except as limited by these Terms of Service. You may not use The BOSs™ service to resell, repackage, or otherwise use in a manner which is not representative of these Terms of Service.

You are solely responsible for the content of your documents and information through The BOSs™. We do not exercise editorial control over your documents or stored information, but we may cancel your account if you violate these Terms of Service.

We ask that you use appropriate language when filling in the name, address and message spaces in our data fields and/or and correspondence within The BOSs™ membership. In addition, you agree that you will not market your business or services through The BOSs™ or submit any unlawful, harassing, libelous, abusive, threatening, harmful, obscene or otherwise objectionable material of any kind or nature.

Your use of The BOSs™ is subject to all applicable local, state, national and international laws and regulations, and you agree not to use The BOSs™ for purposes that violate such laws and regulations. In addition, you agree that (1) you will not interfere with another member's use and enjoyment of The BOSs™; (2) you will not interfere with or disrupt networks connected to The BOSs™, and will comply with all regulations, policies and procedures of such networks; and (3) you will comply with United States law regarding the transmission of technical data exported from the United States.

You also agree to indemnify and hold The BOSs™, as well as its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees and independent contractors, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of The BOSs™, your violation of these Terms of Service, or your violation of the rights of any third party.

We may terminate or suspend your access to all or part of The BOSs™, without notice, if you violate these Terms of Service or if you engage in any conduct that we, in our sole discretion, believe is in violation of any applicable law or regulation or is otherwise harmful to the interests of The BOSs™, any other customer of The BOSs™, or any third party.

Customer Feedback

We enjoy hearing from you and welcome your comments about our services and products. However, The BOSs™'s company policy does not allow us to accept or consider creative ideas, suggestions or materials other than those we have specifically requested. Of course, you are welcome to incorporate your original creative ideas, suggestions or materials (such as original artwork, procedures or forms) into your storage space provided and send them to us in an acceptable electronic form to be considered for addition to The BOSs™ knowledge base. The consideration to add or reject such submissions are solely within our rights and no monetary value or personal recognition will be considered unless such a program is offered by our Company.

When you submit such documents to our Company for review, you automatically grant to The BOSs™ (or warrant that you have the right to so grant) a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, display, create derivative works from and distribute the materials or suggestions you submit or to incorporate the materials or suggestions you submit into any form, medium or technology now known or later developed throughout the universe. In addition, you warrant that all "moral rights" in the materials or suggestions you submit have been waived.

The BOSs™'s web site contains copyrighted materials, trademarks, service marks, trade dress and other proprietary materials owned by The BOSs™ or its licensors and protected by law. All content on this site, including text, graphics, icons, images and software, is the property of The BOSs™ or its content suppliers and is protected by United States and international copyright laws. All rights in such materials are reserved to The BOSs™ or its licensors.

You may use these materials within your primary business facility which has been properly registered and is in current standing for all subscription fees due. You may not use the materials for any other purpose, or copy the materials in whole or in part, or provide to any other party, business, individual other than the registered user(s) for The BOSs™ product without prior written permission from The BOSs™.

If subscription fees become past due or any breach of the Terms of Service are determined solely by our staff or in conjunction with information supplied by others outside our Company, access to The BOSs™ may be immediately terminated.

Limitation of Liability

By using this site, you expressly agree that such use is at your sole risk. The BOSs™ endeavors to provide service of the highest quality, but we cannot guarantee that our service will be uninterrupted or error-free, or that your information will be completely protected from loss resulting in any system failure, network, internet, or Act of God. We are not responsible for claims brought by third parties arising from your use of The BOSs™.

The BOSs™ provides this site and its contents on an "as is" basis and makes no representations or warranties of any kind, express or implied, with respect to this site or its operation, contents, or products. We do not represent or warrant that information available on this site is accurate, current, or complete, and we disclaim any and all representations and warranties, including but not limited to any warranty of merchantability or fitness for a particular purpose to the full extent permitted by applicable law.

In no event shall The BOSs™ be liable to you or any other person or entity, under any theory, including negligence, for damages of any kind arising from the use of this site, including but not limited to direct, indirect, actual, incidental, punitive, special or consequential damages, lost income, revenue or profits, lost or damaged data, or other commercial or economic loss, that result from your use of, or inability to use, this site, even if The BOSs™ has been advised of the possibility of such damages or such damages are foreseeable. By using The BOSs™, you agree that this limitation will apply to all services, content and merchandise available through The BOSs™. In the event that applicable law does not allow the limitation or exclusion of liability or damages, you agree that in no event shall The BOSs™'s total liability to you for all damages, losses and causes of action of any kind exceed the amount, if any, you have paid The BOSs™ for use of The BOSs™ that current calendar year.

Applicable Law

This site is created, controlled and operated by The BOSs™ in the State of Indiana, USA, regardless of the hosting center's locations, and the laws of the State of Indiana will govern your use of The BOSs™ site and the interpretation of these disclaimers, without giving any effect to principles of conflict of laws. If you choose to access this site from another location, you are responsible for complying with local laws, if and to the extent that local laws are applicable. Under United States export controls, software from this site may not be downloaded or otherwise exported or re-exported (1) into, or to a national resident of, Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other country to which the United States has embargoed goods; or (2) to anyone on the United States Treasury Department's list of Specially Designated Nationals or the United States Commerce Department's Table of Deny Orders.
